This Privacy Policy explains how and why the Company collects, uses, discloses or otherwise processes your information, including personal information, through our websites or applications (collectively, the “Services”) where this Privacy Policy is posted, as well as offline when you interact with us (such as through written or verbal communications between you and the Company).  Each time you access or use our Services or otherwise interact with the Company, you consent to the collection and use of your personal information by the Company in the manner specified in this Privacy Policy.   

We may supplement this Privacy Policy with additional information relating to a particular service, product or transaction with you, such as the privacy policy for software that may accompany our products.  This Privacy Policy does not apply to any Company websites that have their own Privacy Policy, such as Privacy Policies posted on the websites for our international operations.

Cookies.
We may collect your information using cookies when you visit our websites.  “Cookies” are small electronic files which a website can use to recognize repeat visitors. Cookies can include web beacons, web logs, pixel tags, passive capture technologies and other technologies.   When you visit our websites, we may place a Cookie on your computer or electronic device to help us to customize your experience or to allow you to use the functions made available via our websites. For example, certain Cookies are necessary to allow you to register your product, make warranty claims or purchase products. We utilize a Cookies consent module to allow you to choose which Cookies you will allow to operate when visiting our websites. Third-Party Marketing and Advertising Service Providers. 
Third-party service providers providing marketing and advertising services to us, including, without limitation, search engines like Google, may show the Company’s advertisements on websites across the internet.  These third-party service providers may use cookies and/or device identifiers to serve such advertisements to you based on your past visits to our website. You can opt out of a third-party service provider’s use of cookies on our website by clicking the “Cookie Preferences” link at the bottom of the website, selecting “Advanced Settings”, and then adjusting which Advertising Cookies may be used by the website or by visiting the  Network Advertising Initiative opt-out page, and you can control the use of device identifiers by using your device’s settings

Website Analytics Information.
We use Google Analytics to ensure website functionality and improve our websites.  This software may record information such as your IP address, location, date of birth and gender, browser type and language, operating system, access time, duration of visit, pages you view within our website, search terms you enter, and other actions you take while visiting us, the pages you view immediately before and after you access our website, how often you use our website, aggregated usage and performance data, application errors, and debugging information.  Google Analytics is owned and controlled by Google LLC.  Data collected by Google is subject to its privacy policy.

4. How we sell, share or disclose your personal information

  • “Share,” “shared,” or “sharing” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged. 

Sale or Sharing of Personal Information.
Under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CPRA”), the disclosure of data received by our third-party advertising and social media partners may be considered a sale of personal information.  We engage such companies, including Google and Facebook, for advertising and data analytics.  We also allow certain entities to place cookies on our websites and applications to collect information about your interaction with such websites and applications to which such companies have access. 

Disclosure of Aggregated and/or De-Identified Information.
We may aggregate and/or de-identify your personal information so that it can no longer be linked to you.  We may use and disclose aggregated/de-identified information for any purpose at our sole discretion.

We may disclose personal information with the following entities: our parent company, affiliates, subsidiaries or divisions (“Affiliates”) and individual colleagues (“Employees”); service providers; trusted business partners; our professional advisors, including lawyers, insurers, accountants and auditors (“Advisors”); and official government bodies, such as government agencies, local authorities, regulators and the police (“Official Government Bodies”). 

Business Purpose for Disclosing Personal Information. 
We may disclose personal information for various business purposes, as described below: 

  • To Perform Job Function: We may disclose personal information with our Employees who need it to do their job, such as fulfilling orders and processing payments, and providing customer service or warranty support. 
  • To Provide Services on Our Behalf: We may disclose personal information with service providers who need your information to provide services to us, such as processing or fulfilling orders, processing payments, maintaining our computer systems, providing security or fraud detection services, providing analytic services, providing advertising services such as ad targeting, remarketing, customized advertising content and administering marketing and advertising campaigns, or providing similar services on our behalf.  
  • To Obtain Professional Advice:  We may disclose personal information, as necessary with our Advisors for the purposes of managing risks, obtaining professional advice, exercising or defending against legal claims, etc. 
  • Legal Compliance: Where it is required or permitted by law, we may provide your personal  information to Official Government Bodies (a) to comply with any legal process; (b) to respond to their requests; (c) to enforce our terms and conditions; (d) to protect our operations and protect our rights, privacy, safety or property, and/or that of you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

Sensitive Personal Information. We only use sensitive personal information for purposes disclosed herein.  We do not use or disclose sensitive personal information for purposes other than authorized purposes.   

Because we operate as part of a global business, the recipients of your information may be located outside the jurisdiction in which you are located. The transfer of your information will be subject to the reasonable security measures described below. 

5. How we protect your information

We will not use your personal information for any purpose other than the purposes described in this Privacy Policy.  We use reasonable security measures, including physical, administrative, and technical safeguards to help us protect your information from unauthorized access, use and disclosure. These measures may include encryption, security certificates, access controls, information security technologies, policies, procedures and other information security measures to help protect your information. We also require our suppliers to protect such information from unauthorized access use and disclosure. 

6. How long we keep your personal information

We will retain your personal information for as long as necessary to fulfill the purposes for which we collected it.  To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. 

7. Your rights if you are a California resident

If you are a resident of California, your right to submit certain requests relating to your personal information is described below.  Please note that these rights are subject to certain exceptions and certain of these rights are subject to verification mechanisms.  You may designate an authorized agent to make the requests below on your behalf; however, you will still need to verify your identity directly with us before your request can be processed.

If you are a California resident, you have the right to know: (1) the categories of personal information we have collected about you; (2) the categories of sources from which the personal information is collected; (3) the business or commercial purpose for collecting, selling, or sharing personal information; (4) the categories of third parties to whom we disclose personal information; and (5) the specific pieces of personal information we have collected about you.  You also have the right to know the list of all third parties to whom we have disclosed personal information, as defined under California Civil Code Section 1798.83(e) (a/k/a the “Shine the Light Law”), during the preceding year for third-party direct marketing purposes.

Right to Correct Inaccurate Information 
California residents also have the right to request that we correct your personal information collected or maintained by us.  If you believe that any of the personal information we maintain about you is inaccurate, you have the right to submit a request for us to correct that information.  Upon receipt of a request, we will use commercially reasonable efforts to correct the information as you direct.  

Right to Request Deletion of Your Personal Information  
California residents also have the right to request that we delete your personal information collected or maintained by us.  We will let you know what, if any, personal information we can delete from our records, and we will direct any service providers that may have collected personal information about you to delete your personal information from their records.  There may be circumstances where we cannot delete your personal information or direct service providers to delete your personal information from their records.  For example, if we need to: (1) retain your personal information to complete a transaction or provide services; (2) detect security incidents; (3) protect against unlawful activities; (4) identify, debug or repair errors; or (5) comply with a legal obligation.   

Exercising Rights to Know, Correct and Delete, and Related Verification Measures

In order to exercise your rights, you are required to submit a request and provide in your request certain basic information about yourself which is necessary to identify your personal information and to verify your identity, including your name, email address, telephone number and mailing address. In response to your request, the Company may request additional information which may be necessary to verify your identity and/or to identify any personal information that may be in the Company’s possession. Your failure or refusal to provide sufficient information to identify your personal information or to verify your identity will be grounds for denying your request.  In the event that the Company requests from you additional information to identify whether the Company is in possession of your personal information or to verify your identity said request for additional information shall not be regarded as a statement as to whether the Company is or is not in possession of your personal information nor shall it be regarded as a statement as to the Company’s intention to fulfill or deny all or any part of your request. Upon receipt of any information that the Company requires to identify your personal information and to verify your identity, the Company will conduct an investigation to determine if your request can be fulfilled.  The Company will comply with your request by responding to your request within the time period proscribed by the relevant laws and regulations. 

Right to Opt-Out of the Sale or Sharing of Your Personal Information.
You may opt-out of the sale or sharing of your personal information, described above, by submitting our customer service form.  You can also exercise your right to opt-out by using a browser that supports an opt-out preference signal (also known as a Global Privacy Control (GPC)).  If you choose to use this signal, you will need to turn it on for each browser you use.   

The Company does not sell or share personal information about California consumers if we have actual knowledge that the consumer is younger than 16 years old. 

Right to Limit the Use of Your Sensitive Personal Information. 
Under the CPRA, California residents have the right to limit the use of sensitive personal information under circumstances.  We only use your sensitive personal information for the following purposes:  (i) to that use which is necessary to perform the services or provide the goods reasonably expected by you; (ii) to help to ensure security and integrity; (iii) to perform services on our behalf; (iv) to undertake activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us; and (v) to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.  Given the nature of our use of your sensitive personal information, you do not have the right to request that we limit the use of your sensitive personal information.

If you choose to exercise any of the privacy rights conferred by the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, you also have the right not to receive discriminatory treatment by us.  This means that, consistent with California law, we will not deny providing our services to you, charge you different prices or provide a different level or quality of service to you unless those differences are related to the value of your personal information. 

8. Your rights if you are a resident of Colorado, Connecticut, Utah or Virginia

If you are a resident of Colorado, Connecticut, Utah or Virginia (except as noted), you have certain additional rights set forth below. Please note that these rights are subject to certain exceptions and certain of these rights are subject to verification mechanisms.   

The Right to Know: You have the right to know whether we are processing your personal information. 

The Right of Access: You have the right to access your personal information, and to obtain a copy of it in a readily usable format, if feasible. 

The Right to Correct Inaccuracies: You may request that inaccuracies in your personal information be corrected.  Utah law does not provide for this right.    

The Right to Delete: You have the right to request that your personal information be deleted, except in cases where retention is required by law or contractual obligation.    

The Right to Data Portability: You have the right to obtain a copy of your data in a portable and, if feasible, readily usable format. 

The Right to Opt-Out: You may elect to prevent your personal information from being:  

  1. Used in targeted advertising; 
  2. Sold; or  
  3. *Used for profiling purposes that may produce legal or similarly significant effects. 

* Utah law does not provide for this right.    

Furthermore, in connection with your sensitive personal data: (a) if you are a resident of Utah, we will not process that information without first presenting you with clear notice and an opportunity to opt out of the processing; and (b) if you are a resident of Colorado, Connecticut or Virginia, we will not process sensitive personal data without obtaining your consent.

If we cannot fulfill your request, we will notify you of that decision and the reasons why within 45 days. At that point if you believe our decision was in error, you can submit an appeal using the method(s) above. If the result is the same, you can also seek assistance and/or redress from your state attorney general. 

9. Nevada Privacy Notice

Nevada law provides that Nevada residents may opt-out of the “sale” of “covered information” to third parties, including but not limited to name, address, social security number, and online service activity.  Our uses of your personal information are not sales under Nevada law, so no opt-out is required. 

10. Personal information of Mexican residents

Under Mexican privacy laws (“Mexican Privacy Laws”), the Company is a controller of information that the Company receives. The Company does not proactively obtain or collect data considered sensitive under Mexican Privacy Laws, such as race, religion, health information, sexual preference or political opinion.  We ask that you do not provide information of this nature to the Company.  In the event that you voluntarily provide us with sensitive information, we will use such information only to the extent that it is necessary to provide the service you requested.  The Company stores, processes and transfers your information for the purposes, in the manners and using the methods described in this Privacy Policy. We retain your information for as long as we have a relationship with you and for a period after the relationship has ended. 

When determining how long to keep your personal information after our relationship with you has ended, we take into account how long we need to retain the information to fulfill the purposes described above and to comply with local laws and regulations. 

We may transfer, process and store your personal information outside of your home country, including in the   United States and Canada. We have put in place appropriate safeguards for such transfers (such as standard contractual clauses and agreements) in accordance with Mexican Privacy Laws. 

Some of the processing we conduct will involve making decisions about you based on automated processing of your personal information. For example, we may conduct profiling activities to select personalized offers or recommendations for you based on your browsing history or your purchase of Company products. Where these decisions are based solely on our automated processing of your personal data, these types of decisions will not have legal or similar effects on you, but you can still contact us for further information and to object to this use of your personal information. 

Mexican Privacy Laws set the rules on when we can send direct marketing communications to you via email, SMS or post. In some circumstances we are required to obtain your affirmative consent; however, to the extent that this privacy policy is not delivered directly or personally to you, you will have a period of five days to express your refusal for the processing of your personal data for purposes other than those that are necessary and give rise to the legal relationship that exists between us. If you do not express your refusal for the processing of your data in accordance with the above, it will be understood that you have given your consent for the processing of such data. 

In addition to the rights described in the section entitled “Your Control of Your Information,” if you have certain rights regarding your personal information. These rights include the rights to: access your personal information; rectify the personal information we hold about you; cancel and delete your personal information; object to our use of your personal information; lodge a complaint with your local data protection authority; and withdraw any consent you have given to use your personal information. When you use the website on which this Privacy Policy is posted, you consent to the collection, processing and use of your personal information, including financial information, sensitive personal information and health information, as described in this Privacy Notice. 

11. Stripe Services

We use Stripe for payment, analytics, and other business services. Stripe collects and processes personal data, including identifying information about the devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection and prevention. 12. Links to other websites

We are not responsible for any information shared by you with third-party websites. Links to third-party websites are provided for your convenience only. Our websites may include social media features such as Facebook® or Twitter® buttons. These sites may automatically record information about your browsing behavior every time you visit a site via a social media button. Our websites may also contain links to advertisements by third parties that are not controlled by the Company and may have different privacy policies. Your use of these features is governed by the privacy policy of the company providing the advertisement or the social media feature, not by this Privacy Policy.

13. Information from children

The Company does not direct its websites or applications to children under thirteen (13) years of age.  No information should be submitted to our websites or applications by persons under 13 years of age.  Persons under the age of 13 are not allowed to register for newsletters, clubs or activities. Individuals under eighteen (18) should consult with their parent or guardian about the use of the Company’s websites or applications for their benefit.  Persons under 18 years old are not allowed to make purchases or participate in contests. When appropriate, the Company may ask you to indicate your date of birth to verify compliance with the age requirements set forth herein.  

The Company does not knowingly collect information from persons under 13 years of age or provide any personal information from such persons to any third party for any reason whatsoever. The Company does not allow persons known to be under 13 years of age to receive direct marketing communications from the Company.  

14. Your control of your information

You have certain choices regarding the use of your information for marketing purposes. Those choices include the right to deactivate any account you have with the Company and to opt-out of receiving any marketing materials from the Company.  The methods by which you can exercise your options to deactivate your account or opt-out are as follows: 

Deactivate your account: If you have an account with us, you may deactivate your account by emailing us at privacy@hamiltonbeach.com  and requesting that we deactivate your account. 

Opt-Out of Promotional Email Communications: You may opt out of promotional email by clicking on the “unsubscribe” link   in the email, or by emailing us at privacy@hamiltonbeach.com, and explaining the email that you would like to unsubscribe from. Please also note that if you have previously added your contact information to the mailing list of one of our clients or partners and later withdraw your consent, you will have to contact that third party to request removal from that third party’s mailing list. 

Opt-Out of Promotional Text Message Communications: You may opt out of promotional text messages by clicking on the “unsubscribe” link in the text message, or by emailing us at privacy@hamiltonbeach.com, and briefly describing the text message that you would like to unsubscribe from. 

Opt-Out of Promotional Mail Communications: You may opt out of promotional mail communications by following   instructions provided in the mailing, or by emailing us at privacy@hamiltonbeach.com , and briefly describing the mailing that you would like to unsubscribe from.

15. Exclusion of anonymous information

Information which is aggregated and anonymized in such a manner that the identity of the natural person to whom the information relates can no longer be identified shall not be considered personal information and shall not be subject to the rights and responsibilities set forth in this Privacy Policy. 

16. Company ownership of information

All opinions, ideas, suggestions, and other feedback submitted to the Company, may be used by the Company without any restriction and free of charge, and nothing contained in this Privacy Policy shall limit or otherwise affect said rights.

Your continued use of our Services after a Privacy Policy modification means you consent to the new Privacy Policy to the extent permitted by law.
